<p>In April 2001 a successful claim was argued at Plymouth County Court on behalf of a Horticultural Assistant claiming that her work had brought about tendonitis. As part of her job the Horticultural Assistant had to clean out plant pots for Lomax Sayers Ltd in preparation for marketing which consisted of her having to rotate both wrists in a circular motion up to 1,000 times per day between the period of 1990-1996.</p>
<p>The judge quoted that &#8220;…the Claimant has proved to the necessary standard that she sustained tendonitis as a result of her work but not epicondylitis or any other injury.&#8221; and as such she was awarded an injury compensation payout of £11,151.66 due to her having to give up her job because of the sustained repetitive strain injury.</p>

<p>In March 2006 a legal secretary was awarded £157,341 in the Court of Appeal for an upper limb disorder as a result of work duties. The legal secretary had been working for 19 years but had to leave due to the pain as a result of her injury. The defendant was found to be in breach of the Health and Safety (Display Screen Equipment) Regulations 1992, and that the injury had been caused by those breaches of statutory duty.</p>

It was proved that the forklift truck was poorly maintained as the machinery continued to work even though a cut off mechanism had been tripped.</p>
